Registration of China Trademark

In China, application shall be made to the Trademark Office of China if the exclusive right of trademark is needed for the provision of goods or services. According to the Trademark Law of China, registered trademarks are those that have been approved by and registered with the Trademark Office and the trademark registrant has the right to exclusively use such trademarks and shall be protected by the laws.

Rights Applicable to China Trademark
  • Right of use: a trademark registrant has the right to use its registered trademark for the approved goods and services and in related commercial activities
  • Exclusive right: no one other than the trademark registrant shall use the identical or similar trademark without permission
  • License right: a trademark registrant has the right to permit others to use its registered trademark as provided by the laws
  • Right of prohibition: a trademark registrant has the right to prohibit others to use a trademark identical with or similar to registered trademark without permission
  • Right to charge: a trademark registrant has the right to charge its registered trademark
  • Right to invest: a trademark registrant has the right to invest its registered trademark as an intangible asset as provided by the laws
  • Right to assign: a trademark registrant has the right to transfer its registered trademark to others with or without consideration
  • Right of succession: a trademark can be succeeded by its lawful successor as an intangible asset according to the legal order of succession

Renewal upon Expiration

The China trademark is subject to renewal upon their expiration. The renewal of each registration will be valid for 10 years.

Notes

Foreigners or foreign enterprises in China must entrust a trademark agency to conduct the matters in relation to the trademark registration, except those who have a habitual residence or a place of business.

Every trademark shall be registered with one graphic design of the trademark for the purpose of each category under the international classification for goods and services. Any single registration of the trademark shall be regarded as one application and a separate application shall be submitted.
